How to transfer a Premises Licence

When licensed premises are sold, let, assigned, surrendered or forfeited the premises licence will need to be transferred to the new owner of the business or to the property owner. This is a transfer of the premises licence, using the attached forms for the application and the consent of the outgoing premises licence holder.

The application can be made so as to have immediate effect, pending the Licensing Authority's consent to the change, or can be forward dated to fit in with the planned date of an assignment or sale.

The applicant can be an individual, or a number of individuals, or a company, or any other legal body, and does not need to hold a personal licence. There are no CRB checks or other checks of financial or legal standing.

The applicant needs the consent of the existing premises licence holder using the attached form, or must give an adequate reason on the application form why that consent is not obtainable.

The premises licence must be attached or a reason given for the failure to do so.

The application and attachments must be copied to the Police, but not to any other regulatory authorities. Only the Police may object, which must be within 14 days of the application and only on the ground of harm to crime prevention. This can lead to a hearing.

The application fee is £23, no VAT

When the application is granted the new holder of the premises licence must notify the DPS. In most cases the DPS will be changing at the same time.

The AWP permits for the gaming machines are now held in the name of the premises licensee. AWP permits cannot be transferred. You will need to apply for the GRANT of a new permit or permits at the same time as the transfer of the licence. The application is made to the same Licensing Authority (no longer the magistrates) using the attached form.

This authority could also be provided in the form of a wall chart in a private location at the back of the bar and if this was done on a chalk board or white board the names could be changed quite easily as bar staff are recruited or give notice.
