Licensing Application
After 24 November 2005 the new licence regime comes into full effect. The types of licence application that need to be made will be:
New premises licence applications to open new premises, to reopen closed licensed premises, to licence premises that require a licence for the first time (late takeaways, sports halls, community halls for example) and to get consent to capital schemes that change the plans of existing licensed premises. A plan of the premises must always be attached.
Application to vary the terms of a licence. This application will be made when adding or removing activities, extending hours and changing licence conditions. No plan of the premises is required.
Application to vary the DPS. The consent of the new DPS must be attached. (see section "How to...")
New personal licence. To be made by anyone seeking to join the industry who has the NCPLH qualification and can get a clean Criminal Records Bureau check. (see section "How to...")
Transfer a premises licence. This happens when a licensed business is bought and sold, leased or surrendered back to the landlord. The consent of the outgoing holder of the licence is required (see section "How to...")
Review any premises licence. This is a process that allows regulators and neighbours to challenge the terms of the present licence if they feel the operation of the licence is causing harm to the licensing objectives.
This will lead to another licensing hearing. If you are a licensee who receives one of these, you must take immediate action to appoint an advisor and generate written support for your business.
